Compliance & Hearing Committees - Violation Process

Day 1 - Compliance Committee tours the community and identifies any potential violations.

Day 2 - Compliance Committee issues letter to property owner.

Day 3 to 16Property Owner has two weeks from the date of the letter to remedy the violation. If
Property Owner cannot remedy violation within the two-week time frame, they must submit a
written plan outlining the time line needed to remedy the violation. Compliance Committee will
review and forward to the board for approval.

Day 17 – Compliance Committee rechecks violation. If property owner has not remedied the
violation, the Compliance Committee will document the violation by taking the necessary
photographs.

Day 18 - At Board of Director's Meeting, the Board votes to fine if violation has not been corrected within
specified time frame.

Day 19 – If fined is voted, the day after Board of Director's Meeting – Board sends a certified and postal letter to
property owner to schedule a hearing in 30 days not to exceed 90 days. Property Owner to pay
$25.00 per certified letter.

Day 49 - At the Hearing Meeting – the Property Owner has an opportunity to present their
facts/case as to why they should not be fined. The Hearing/Fining Committee will make a final
decision as to whether or not the Property Owner is fined. If Property Owner submits a written
plan outlining the time line needed to remedy the violation. Hearing/Fining will forward on to the
Compliance Committee for review and ultimately forward to the Board for approval.
 
Day 50 - If fine was given, Hearing/ Fining Committee will issue a certified and postal letter
notifying the Property Owner has been fined. There is an additional seven-day grace window after
the hearing to remedy the violation from the date of the letter. Property Owner to pay $25.00 per
certified letter. ALL PRIVILEGES USING THE REC CENTER (Basketball, Tennis, Pickleball, Playground, Bocce Ball and Picnic area) are suspended until the violation and fine have been corrected and paid.

Day 57 - On eighth day if violation is not corrected, $100.00 fine per day starts for ten days (10-day
fining period) up to a maximum of $1,000.00. Hearing/Fining Committee will visit the property in
question on a daily basis for inspection to determine the dates and the amount of the fine.

Day 68 – Hearing/Fining Committee notifies Treasurer as to the amount of the fine.

Day 69- Treasurer prepares and mails invoice for the amount of the fine to the property owner has
30 days to remit their payment for the fine.

Day 99 - If property owner has not paid, the treasurer will forward the assessment to the attorney
for further collection efforts including liens and potential foreclosure.
